These terms and conditions apply to Wallet and Wallet Credits (Credits) created by Booking.com B.V.
Booking.com B.V. (referred to as “Booking.com”) is a private limited company organised under the laws of the Netherlands and having its registered office at Herengracht 597, 1017 CE Amsterdam, the Netherlands, and owns and operates the platform www.booking.com. By creating, using, earning and/or redeeming the Wallet and/or Credits, you (“Member”) are agreeing to and accept these terms and conditions.

Usage
Wallet Credits may only be used toward the purchase of eligible products on www.booking.com and may only be gained, earned and used in accordance with the rules and guidelines in these terms and conditions. In order to use Credits, an account with Booking.com is necessary. Purchases are deducted from the redeemer's Wallet balance. Any unused balance will remain associated with the redeemer's Booking.com account and applied to purchases in order of earliest expiration date. If a purchase exceeds the redeemer's Wallet balance, the remaining amount must be promptly paid with another available and accepted payment method. In the event that you have not timely paid any remaining balance, your reservation or purchase (as applicable) may be cancelled (without further (advance) notice) and you will forfeit any Credits and not be entitled to any repayment (unless agreed otherwise by the relevant travel provider). Booking.com disclaims any liability for any used, canceled, expired or forfeited Credits.

Compliance with the Wallet terms
The Member guarantees the correctness of all information given, including but not limited to a mailing address and an e-mail address, and shall be solely responsible for any erroneous, incomplete or out-of-date information. All data, including personal data shall be used and exchanged by Booking.com and its partners as required by the Wallet programme or under the service for which the Credits are used. All personal data relating to the participation of Members in the Wallet programme will be processed and used for purposes serving Wallet programme implementation and execution in accordance with applicable data protection laws and regulations. For further details we refer to the privacy policy of Booking.com available at www.booking.com or in the Booking.com app.
The Member shall upon first request of Booking.com provide valid proof of identity. Failure to do so within 30 days will automatically lead to suspension or termination of the Wallet membership and forfeiture of all Credits accrued. Loss, theft or damage of Wallet access (credentials) or Credits are for the risk and account of the Member. Lost, stolen or expired Credits will not be refunded, replaced or extended.

Limitations
Wallet Credits have an expiration period as from time to time determined by Booking.com. Different expiration periods can be applied to different Credits. The expiration date of Credits are displayed on www.booking.com in the user account settings section. Credits cannot be converted into or (re)claimed in cash or otherwise paid out. Booking.com is at all times and without advance notice entitled to set off and settle any Credits with any claim Booking.com may have on you.
The Wallet programme is open solely to individuals aged 18 years or older. All persons applying for membership of the Wallet programme shall be deemed to have read, understood and accepted these terms and conditions. Booking.com reserves the right to refuse membership to any person who does not meet the requirements for participation (as from time to time set by Booking.com).
The Wallet and Credits cannot under any circumstances be transferred, bequeathed, set over, encumbered, assigned, (re)sold or combined, whether or not for valuable consideration, to any third party (whether or not that person has an account. In the event of the death of a Member, Booking.com shall close that Member’s account and cancel all Credits earned by the concerned Member upon receipt of the death certificate.
All claims for retroactive Credits should be made within six (6) months after the relevant eligible transaction in question. Retroclaims should be sent to the Customer Service Centre by regular mail (see below) and should to be supported by the relevant documents. Booking.com reserves the right to demand at any time all documentary evidence of the Credits accrual. Documents submitted to the Customer Service Centre cannot be returned; therefore it is advised to keep copies of such documents.

Fraud
In the event of concerns related to fraud, misuse or misbehaviour, Booking.com retains the right to unilaterally and without notice close the account and you shall forfeit all Credits (which shall immediately be confiscated, expire and cancel). Booking.com reserves the right to debit the account of any Member who has acquired Credits unduly or in violation of these terms and conditions.

Use of Wallet in Violation of these Terms and Conditions
By using the Wallet you agree to comply with these terms and conditions, and not to use the Wallet and the Credits in any manner that is misleading, deceptive, unfair, or otherwise harmful to Booking.com, its affiliates, or its customers. Booking.com reserves the right, without notice to you, to suspend or terminate the Wallet and any associated balance without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel, confiscate, expire and forfeit the Credits, cancel or limit orders, and bill alternative forms of payment, if we suspect that the Wallet or Credits are used, or applied to an Booking.com account (or your Booking.com balance is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.

Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of The Netherlands. You and Booking.com each agree to submit to the exclusive jurisdiction of the courts at The Netherlands. You agree to indemnify Booking.com for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions.

(Limitation of) Liability
We make no warranties, express or implied, with respect to Wallet balance, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. If applicable law does not allow limitations on implied warranties or the exclusion or limitation of certain damages, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.
The Member is liable for any claims from third parties, including the tax authorities, arising from membership in or use of the Wallet programme and Credits.
Booking.com shall not be liable for any loss, expense (including, without limitation, attorneys' fees), accident or inconvenience that may arise in connection with the use or redemption of Credits.
The limitations of liability as set out in the terms and conditions of Booking.com (for usage of the website/app and online reservation service) available at www.booking.com or the Booking.com app shall fully apply (and are hereby deemed to be incorporated into and form an integral part of these terms and conditions).

General Terms
Booking.com reserves the right to cancel, replace and change these Wallet terms and conditions (including the accumulation and redemption structure) from time to time at its own discretion and without prior notice. All terms and conditions are applicable to the extent permitted by law. No damage claims against Booking.com by Members may be lodged as a result of legally required country-specific alterations.
The Wallet programme may be terminated by Booking.com at any time and for any reason. Booking.com will make reasonable efforts to give Members prior notice of termination of the Wallet programme. If Booking.com terminates the contract, all Credits shall expire six months from the notification of termination or after the applicable Credits validity date, whichever occurs first.
Booking.com reserves the right to audit any and all accounts in the Wallet programme at any time and without notice to the Member to ensure compliance with the Wallet programme or investigate (alleged) fraud or misuse.
